Robert Markette

Robert W. Markette, Jr., CHC is a partner in the law firm Gilliland & Markette LLP. For more than 25 years, Gilliand & Markette, LLP has advised home health, hospice, and private duty providers on a wide range of legal matters from employment and labor law to Medicare and Medicaid compliance.

Robert's primary areas of practice are health law, fraud and abuse, employment law, and litigation. Robert is certified in health care compliance by the Health Care Compliance Board.

Robert assists home health agencies, hospices, private duty agencies as well as county health departments, nursing facilities and other health care providers with a wide range of health care compliance and litigation issues. Robert has counseled clients on fraud and abuse issues ranging from joint ventures to marketing efforts. Robert has advised clients on HIPAA privacy and security compliance, Medicare certification, licensure, business transactions including changes of ownership and many other health law matters.

Robert has represented clients before administrative law judges, state and federal courts and before the Indiana Supreme Court. Robert has litigated matters including non-competition violations, licensure revocations, recoupment actions, wage and hour violations, and contract disputes.

Robert has assisted clients during surveys and audits. Robert has also guided clients through fraud and abuse investigations, including assisting with internal investigations, responding to government inquiries, and negotiation settlements.

Robert has spoken across the country on health law matters including HIPAA Compliance, Fraud and Abuse, Medicare Compliance, Home Health Advanced Beneficiary Notices, Wage and Hour compliance, and Non-Competition Agreements.

Robert drafted the HIPAA Security Rule Compliance Manual, a comprehensive manual containing a detailed explanation of the Security Rule as well as template policies and forms designed to assist health care providers in complying with the HIPAA security rule.

Robert also assisted John Gilliland in researching and drafting a number of state law versions of The HIPAA Privacy Compliance Resource Manual, a comprehensive manual of template policies and forms to assist health care providers in meeting the requirements of the HIPAA privacy rule.

Robert is a regular contributor to Home Health and the Law, a publication of the Indiana Association for Home and Hospice Care. He has also authored numerous articles on fraud and abuse, HIPAA, and other health law topics for the Remington Report and other trade publications.

Robert graduated from Hanover College with a degree in Computer Science and received his law degree from Indiana University School of Law in Bloomington, Indiana. During law school he served on the Federal Communications Law Journal. Robert is a member of the American Health Lawyers Association, the Health Care Compliance Association and the Indiana State Bar Association.
